1. Agreement to terms

By accessing or using apextruthhealth.com you agree to these Terms of Service. If you do not agree, do not use the site. These terms apply to all visitors, readers, account holders, buyers, sellers, and Farm Direct participants.

2. What ATH is and is not

ATH is:

  • An independent editorial publication covering health research, funding sources, and clean living
  • A marketplace connecting buyers with independent American small businesses
  • A Farm Direct portal connecting buyers with verified farmers

ATH is not:

  • A medical provider, licensed healthcare professional, or medical practice
  • A replacement for professional medical advice, diagnosis, or treatment
  • A guarantor of the accuracy of any linked third-party study or source

Nothing on this site constitutes medical advice. Editorial content is research journalism and commentary intended to help readers understand what published research says and who funded it. It is not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult a qualified healthcare professional before making health decisions.

3. Editorial content

ATH publishes investigative health journalism and commentary on matters of public interest, including the funding sources behind published health research, the relationship between industry funding and study outcomes, regulatory history and policy decisions affecting public health, and product ingredients and sourcing practices.

Editorial content represents the analysis, commentary, and opinion of ATH and its editors based on primary sources. Where ATH states facts, those facts are sourced to named studies, named researchers, and named funders. Where ATH draws conclusions or expresses opinions, those opinions are framed as such.

ATH follows the funding explicitly. When research relevant to a claim was funded by an entity with a financial interest in the outcome, ATH discloses that funding. This is editorial methodology. Funding disclosure is standard practice in academic publishing and investigative journalism.

Truth is our editorial standard. All factual claims are traceable to primary sources. If you believe a factual claim on ATH is inaccurate, email hello@apextruthhealth.com with the specific claim and the evidence you believe contradicts it. We will investigate and publish corrections where warranted.

ATH operates under the protections afforded to the press under the First Amendment to the United States Constitution, including the right to publish commentary, criticism, and analysis of matters of public concern. See our Editorial Policy for our full sourcing methodology.

4. No medical advice

The health and wellness content on ATH is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

  • Do not disregard professional medical advice or delay seeking it because of something you read on ATH.
  • Do not use ATH content to self-diagnose or self-treat any medical condition.
  • If you have a medical emergency, call emergency services immediately.

ATH does not recommend or endorse specific treatments, procedures, medications, or physicians. Product listings on the marketplace are not medical endorsements.

5. Marketplace: buyer terms

ATH operates as a marketplace facilitator. Individual sellers fulfill and ship their own orders. Your purchase contract is with the seller, not ATH.

Payment: Processed by Stripe. ATH does not store your payment card information.

Shipping: Each seller ships independently. ATH is not responsible for shipping delays, carrier errors, or lost packages once an order has been handed to a carrier.

Returns: Return policies are set by individual sellers and disclosed on their listings. Contact the seller directly. If a seller does not respond within 5 business days, contact hello@apextruthhealth.com and we will assist.

Product claims: ATH vets sellers against our sourcing standards. We do not independently verify every product claim. Sellers are responsible for the accuracy of their listings and the legality of their products.

6. Marketplace: seller terms

By listing products on ATH, sellers agree to:

  • Provide accurate, complete, and lawful product descriptions
  • Not make disease treatment claims (diagnose, treat, cure, prevent) without FDA authorization
  • Ship orders within the timeframe disclosed on their listing
  • Handle returns per their stated return policy
  • Comply with all applicable federal and state laws, including FTC regulations on endorsements
  • Comply with INFORM Act requirements at the applicable threshold
  • Indemnify and hold ATH harmless from any claims arising from their products or listings

ATH may remove any listing, suspend any seller account, and withhold or reverse payouts for violations of these terms, at ATH's sole discretion.

7. Farm Direct

  • Farmer listings are subject to verification of claimed certifications
  • Farmers are responsible for the accuracy of all listing information
  • ATH does not guarantee the availability, quality, or safety of Farm Direct products
  • Institutional and commercial buyers are permitted at farmer-set prices

8. Accounts

You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@apextruthhealth.com if you suspect unauthorized access. You may not create accounts using false information or use accounts for commercial data harvesting. We may suspend or terminate accounts that violate these terms or engage in abusive behavior.

9. ATH Coach subscriptions

Plans and pricing: ATH Apex is $7.99 per month. ATH Sports is $19.99 per month. Pricing is displayed at apextruthhealth.com/coach. We may update pricing with 7 days notice to existing subscribers.

Free trial: Both plans include a 7-day free trial. No credit card is required to start a trial. At the end of the trial period, your subscription converts to paid unless you cancel before the trial ends.

Billing: Subscriptions are billed monthly to the payment method on file, starting the day after your free trial ends. Billing is handled by Stripe. You can update your payment method at any time in account settings.

Cancellation: You may cancel at any time from account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods. Cancelling during a free trial prevents any charge.

What coaching is: ATH Coach is an AI-assisted coaching tool built on the same research foundation as ATH editorial content. It is not a licensed clinical service, medical advice, or a substitute for professional healthcare. Coaching conversations are not monitored by licensed healthcare professionals.

Anthropic API: Coaching responses are generated using the Anthropic API. Your messages are sent to Anthropic for processing. Anthropic's usage policies apply. We do not use your coaching conversations to train AI models.

Your health data pledge

ATH collects health-related data to power personalized features: your coaching intake profile, biomarker results, health score inputs, and profile question responses. This section states exactly how that data will and will not be used. These are not aspirational policies. They are contractual commitments.

We will never sell your individual health data. Not to insurance companies, hospitals, health systems, pharmaceutical companies, employers, advertisers, data brokers, research institutions, or any other third party. This commitment applies regardless of ATH's ownership, funding, or financial condition.

We will never share your individual health data. Your biomarker results, lab values, coaching conversations, health score inputs, and profile responses are accessible only to you through your authenticated account. The only exception is Anthropic, which processes coaching messages in real time to generate responses and does not retain them after the session.

Your health data has exactly two uses. First: generating your personalized outputs on ATH, including your coaching responses, your health score, and your content recommendations. Second: improving the internal predictive models that generate those outputs over time.

Research and grants. ATH is pursuing federal research funding to improve the models that power its health scoring and personalization features. Any research publication, grant application, or external scientific communication uses only aggregate, non-identifiable data derived from the model. No individual health record is ever part of a research output. Deleting your account removes your data from all systems and excludes it from any future research use.

Acquisition. If ATH is acquired, this health data pledge transfers as a binding obligation on the acquirer. If a proposed acquisition would require modifying this pledge, ATH will provide 90 days notice and the option to delete all data before the transaction closes.

10. ATH Labs

What ATH Labs is: ATH Labs is an educational tool that provides research-based context for biomarker values. It is not a medical diagnostic service. ATH Labs does not diagnose, treat, cure, or prevent any medical condition. It does not constitute a clinical relationship between you and ATH or any licensed healthcare provider.

ATH optimal ranges: The optimal ranges ATH uses differ from mainstream reference ranges used by clinical laboratories. ATH optimal ranges are sourced to published independent research and represent the ATH editorial team's assessment of what the research supports as optimal for healthy adults. These ranges are not clinical guidelines and should not be used to make medical decisions without consulting a qualified healthcare professional.

Lab panel ordering: When ATH facilitates lab panel orders, those orders are authorized by a licensed physician affiliated with our lab partner's network. The ordering physician relationship is with the lab partner, not ATH. Results are delivered directly to you by the lab and are not transmitted to ATH under the current model.

Manual entry: Values you enter manually or extract from a PDF are self-reported. ATH does not verify the accuracy of self-reported values. Errors in data entry will produce incorrect interpretations. Review all entered values before saving.

FSA and HSA: ATH is actively working toward FSA and HSA eligibility for lab panels. Eligibility is determined by your specific plan and the panel ordered. ATH makes no guarantee of FSA or HSA reimbursement and is not responsible for reimbursement decisions made by your plan administrator.

Data and deletion: Your lab results are stored in your account and deleted permanently when you delete your account. See the health data pledge above and our Privacy Policy for full details.

11. Intellectual property

All editorial content on ATH, including articles, analysis, research briefs, the ATH scoring methodology, and the ATH brand, is the intellectual property of ApexTruth Health LLC.

You may share ATH content for personal, non-commercial, and educational purposes with attribution and a link to the original. You may not reproduce ATH articles in full, scrape ATH content for AI training datasets, or use ATH content for commercial purposes without written permission.

12. Disclaimer of warranties

ATH is provided "as is" and "as available." We do not warrant that the site will be uninterrupted or error-free. We do not warrant the accuracy or completeness of any content. We do not warrant that any product sold through the marketplace is safe, effective, or fit for any particular purpose. To the fullest extent permitted by law, ATH disclaims all warranties, express or implied.

13. Limitation of liability

To the fullest extent permitted by law, ApexTruth Health LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the site, any product purchased through the marketplace, or any editorial content published on the site. Our total liability for any claim shall not exceed the greater of (a) the amount you paid to ATH in the 12 months preceding the claim, or (b) one hundred dollars ($100).

14. Indemnification

You agree to indemnify and hold harmless ApexTruth Health LLC and its officers, employees, and contractors from any claims, damages, losses, and expenses (including reasonable attorney fees) arising from your use of the site, your violation of these terms, or your violation of any third party's rights.

15. Anti-SLAPP notice

ATH publishes content on matters of public interest and concern. Iowa Code Chapter 657A provides protections against Strategic Lawsuits Against Public Participation, commonly known as SLAPPs. These are lawsuits filed primarily to intimidate or burden speakers exercising First Amendment rights rather than to seek legitimate legal relief.

Any party considering legal action against ATH based on its editorial content is advised that ATH will assert all available anti-SLAPP defenses and seek recovery of attorney fees and costs as provided by applicable law.

ATH's editorial content is grounded in primary sources, named funders, and evidence-based analysis. Truth is an absolute defense to defamation under applicable law. Commentary and opinion on matters of public concern is protected speech under the First Amendment.

16. Governing law and disputes

These terms are governed by the laws of the State of Iowa. Any dispute shall first be subject to good-faith negotiation. If negotiation fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in Iowa. You waive the right to participate in class action litigation.

This arbitration clause does not apply to claims that qualify for small claims court or to claims by ATH to protect its intellectual property.

17. Changes to these terms

We may update these terms at any time. Material changes will be posted at apextruthhealth.com/terms with an updated version and date. Continued use of the site after changes constitutes acceptance of the updated terms.
